Terms of service

These terms apply when you book a shoot with PHX Valley Media. Booking a shoot means accepting them.

Booking and estimates

The figure the booking form produces is an estimate, not an invoice. It is calculated from the size band you select, the package and add-ons you tick, and the travel area the property falls in. We confirm the appointment and the final figure before anything is scheduled.

A property is priced against its actual square footage. If the size band selected at booking turns out to be wrong, the price moves to the correct band and we tell you before we shoot, not after. Properties over 7,500 sq ft and commercial properties are scoped individually and quoted in writing.

Travel is included within the first 30 miles of our Scottsdale base. Beyond that a travel fee applies, and it is shown to you before you book — never added to the invoice afterward.

Payment

We do not take prepayment or a deposit, unless we say otherwise for a custom, commercial or travel-intensive assignment. You are invoiced after the shoot.

The finished Media and the invoice are delivered through HD Photo Hub. You may be given access to preview the Media before paying. A preview is for review only. It may not be downloaded, published, submitted to an MLS, copied, screen-captured or used in any marketing.

Payment is due before the downloadable files are released. HD Photo Hub processes the invoice and controls access to the gallery, so paying is what unlocks the download. Where we have approved separate invoicing terms for a client, payment is due by the date shown on the invoice.

The license described under Media and copyright takes effect only on payment in full. Until then we retain all rights in the Media and no use of it is permitted.

Canceling and rescheduling

Cancel or move a shoot at any time and there is no charge. We would rather you tell us the night before than have us drive out to a house that is not ready.

Aerial work depends on weather and airspace. If either makes a flight unsafe or unlawful on the day, we reschedule that portion at no charge.

Access and the property

We need to get in, and the property needs to be ready to photograph. Preparing it — tidying, lights on, blinds set, cars off the driveway, bins away — is the client's responsibility. We will move a small item out of frame, but we are not a staging service and we do not clean.

By booking, you confirm that you have the authority to permit photography of the property, including the consent of the owner and any occupant where that is needed. If a seller or tenant objects on the day, we stop.

If we arrive and cannot get in, or the property is plainly not ready, we will contact you and reschedule.

Media and copyright

PHX Valley Media retains copyright in everything we produce — photographs, video, drone footage, floor plans, virtual staging, twilight edits and anything else we shoot or make for you. These terms call all of it the Media. This is the standard arrangement in real estate photography and it is what lets us keep prices where they are.

On payment in full, the client who commissioned the shoot receives a non-exclusive, royalty-free and non-transferable license to use the Media solely to market the property we photographed.

The license starts when payment is received and runs until the first of:

• the property is sold or leased;
• your listing agreement for the property ends;
• the listing is withdrawn or canceled; or
• 12 months after delivery.

Until then, use the Media on the MLS, listing portals, social media, print, email marketing, property websites and your own or your brokerage's website — for that property.

You may pass the Media to the MLS, listing portals, the property owner, your brokerage and your marketing vendors, so they can market that property on your behalf. That is permission to use it for you, not a handover: none of them gains ownership or any independent right to reuse, sell, license or transfer the Media.

Nothing has to come down when the license ends. Social posts and finished marketing published lawfully while the license was running can stay up. What ends is new use — the Media may not go into new advertising or be republished after that point.

The Media may not be:

• sold, sublicensed or transferred to another agent, photographer or business;
• used to market a different property, including a similar unit in the same development;
• used independently by a builder, architect, designer, stager, publication or other third party without our written permission;
• materially altered in a way that misrepresents the property; or
• used to train an artificial-intelligence system, or to generate unrelated synthetic content.

Ordinary cropping, resizing and formatting for a platform are fine.

If the listing changes hands, the license does not transfer to the incoming agent. They are welcome to contact us for one of their own — this is usually a short conversation, not an obstacle.

Please credit PHX Valley Media where the platform allows it. It is appreciated rather than required.

Our own portfolio

We use Media from the work we shoot in our own portfolio, on this website, in social media and in advertising. Our right to do that is not limited by the license term above — that term governs your use of the Media, not ours.

You can opt out. Tell us in writing before the shoot and that property will not appear in anything of ours. Asking afterward is also fine — we will take it down — but before is easier for everyone.

Drone and aerial work

Aerial work is conducted under FAA Part 107. We obtain any required FAA airspace authorization before flying. We will decline or postpone a flight where airspace, weather, or conditions on the ground make it unsafe or unlawful, and that judgment is ours to make on the day. Nothing in a booking obliges us to fly.

Delivery

The Media is delivered as a gallery hosted by HD Photo Hub. You may see a preview before payment, but the downloadable files are released only on payment in full, unless we have approved separate invoicing terms with you.

Standard photos are delivered by noon the next business day. Video, virtual staging and twilight sessions run longer — 24 to 48 hours for video and virtual staging, next business day for twilight. Same-day photos are available for $75 when the shoot finishes before 2:00 PM and rush availability is confirmed. These are the turnarounds we work to, not guarantees.

Photo galleries carry the full-resolution files, which are suitable both for the MLS and for print. Other deliverables may arrive as a download, an embedded viewer, a property website or an external link through HD Photo Hub.

Download your files promptly and keep your own copy. HD Photo Hub may keep past orders and galleries available, but neither we nor they guarantee that any gallery stays hosted indefinitely.

Review, corrections and refunds

You get to look before you pay. Review the preview in HD Photo Hub and tell us promptly about any material technical fault, any agreed deliverable that is missing, or anything that departs significantly from the scope we confirmed.

We want you satisfied and we will make reasonable efforts to put a genuine problem right — correcting an edit, replacing an affected image, or another reasonable step. Which remedy, including any reshoot, credit or refund, is our decision unless the law says otherwise.

Creative preference is not a fault, and neither are the conditions we found on the day: how the property was prepared, its furnishings and decor, weather, landscaping, light, construction nearby, occupants, parked cars and limits on access. None of those require a reshoot or a refund.

Once you approve or pay for the Media the order is accepted and payments are nonrefundable. Downloading, publishing, submitting or otherwise using any of the Media counts as acceptance too.

Nothing in this section limits a right that cannot lawfully be limited.

Liability

To the fullest extent permitted by law, our total liability for any claim connected with a shoot or order is limited to the amount paid for the service affected. We are not liable for indirect, incidental or consequential losses — a listing that went up late, a transaction that did not complete, a lost commission, or income you expected to make.

This limit does not apply to liability that cannot lawfully be excluded or limited.

Governing law

These terms are governed by the laws of the State of Arizona, and any dispute belongs in the courts of Maricopa County, Arizona.

Changes

We may update these terms. The version in force for your shoot is the one published when you booked it, and the date at the top of this page tells you when it last changed.
